Who we are

Niz ("Niz", "we", "us", or "our") is an AI-powered iOS keyboard designed to help users generate suggested replies based on conversation screenshots they choose to provide.

For the purposes of applicable data protection law, including the General Data Protection Regulation ("GDPR"), Thomas Boudru is the data controller for personal data processed by Niz, except where a third-party provider acts as an independent controller.

Scope of this Privacy Policy

This Privacy Policy explains how Niz processes personal data when you use the Niz application, keyboard extension, website and related services (collectively, the "Services").

Niz is intended only for individuals aged 18 or older.

How Niz works

Niz helps you compose replies to conversations.

When you request a suggestion, you may choose to provide one or more screenshots containing a conversation. Niz processes the content of those screenshots in order to understand the context of the conversation and generate suggested replies.

Niz does not continuously read or monitor the content displayed on your screen.

Nothing generated by Niz is automatically sent to another person. You remain responsible for choosing whether to use, modify or send a suggested reply.

Personal data we process

Depending on what appears in a screenshot you choose to provide, Niz may temporarily process:

• written messages and conversation content;
• names, usernames or profile names;
• profile pictures or other images;
• dates, times and other information visible in the screenshot;
• any other information that you or another person has included in the captured conversation.

Because you determine what appears in the screenshots you provide, they may contain personal data relating both to you and to other individuals.

We ask you not to provide screenshots containing information that is unnecessary for the generation of a reply, particularly highly sensitive information.

At present, Niz does not require you to create a user account.

Niz does not currently use advertising trackers or third-party analytics tools.

Why we process this data

Conversation screenshots and their contents are processed for the purpose of providing the functionality you request: understanding the relevant conversation context and generating suggested replies.

Where required under applicable law, processing is based on your consent and/or is necessary to provide the service that you have explicitly requested.

You decide whether and when to submit a screenshot for processing.

Use of artificial intelligence and OpenAI

To generate suggested replies, Niz uses artificial intelligence services provided by OpenAI.

This means that conversation content, including personal data relating to you or other individuals appearing in a screenshot, may be processed by OpenAI for the purpose of generating the requested response.

Niz does not authorize OpenAI to use API inputs and outputs for training its models. According to OpenAI's current API data policies, API inputs and outputs are not used to train OpenAI models by default unless the API customer explicitly opts in.

OpenAI may nevertheless retain certain API inputs and outputs for a limited period for purposes including service provision, security and abuse prevention, subject to OpenAI's applicable data retention policies and the particular API services used.

You will be informed that content is transmitted to OpenAI and, where required, asked for permission before such transmission occurs.

Screenshot storage and retention

Niz does not maintain a stored archive of the screenshots you submit for AI generation.

Screenshots are processed for the purpose of fulfilling your generation request and are not intentionally persisted by Niz as part of a conversation history.

However, information transmitted to OpenAI is subject to OpenAI's own processing and retention practices. OpenAI currently states that, for most API services, API inputs and outputs may be retained for up to 30 days for service operation and abuse monitoring, unless a different retention arrangement applies.

We may also retain information where required to comply with a legal obligation, resolve a dispute or protect our legal rights.

Data relating to other people

Screenshots you provide may contain information about another person, such as a conversation partner.

You should only provide content that you are lawfully entitled to use and should avoid submitting unnecessary, highly sensitive, confidential or private information.

You are responsible for the content you choose to submit through Niz.

Niz is designed to minimize processing by allowing you to choose when and what content is submitted for AI processing.

Third-party service providers

At present, the principal third-party provider that receives conversation content for AI generation is:

We may introduce additional technical service providers in the future. If this materially changes how your personal data is processed, this Privacy Policy will be updated accordingly.

International data transfers

Some service providers used by Niz may process personal data outside Belgium or the European Economic Area.

Where personal data is transferred internationally, we seek to rely on appropriate safeguards required by applicable data protection law, including applicable adequacy decisions, contractual safeguards or other lawful transfer mechanisms.

Security

We take reasonable technical and organizational measures designed to protect personal data processed through Niz against unauthorized access, loss, misuse, alteration or disclosure.

However, no internet transmission or electronic processing system can be guaranteed to be completely secure.

Your rights under the GDPR

If the GDPR applies to you, you may have the right to:

• obtain information about the processing of your personal data;
• request access to your personal data;
• request correction of inaccurate personal data;
• request deletion of your personal data;
• request restriction of processing;
• object to certain processing;
• receive certain personal data in a portable format;
• withdraw consent at any time where processing is based on consent.

Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.

Because Niz does not currently maintain user accounts or a persistent archive of submitted screenshots, we may not always hold information that allows us to identify or retrieve a particular screenshot after a generation request has been completed.

Right to lodge a complaint

You have the right to lodge a complaint with the competent data protection authority.

In Belgium, the supervisory authority is the Belgian Data Protection Authority (Autorité de protection des données / Gegevensbeschermingsautoriteit).

You may also contact the supervisory authority of the EU Member State in which you live or work, where applicable.

Children

Niz is intended exclusively for users aged 18 or older.

We do not knowingly offer Niz to children or knowingly collect personal data directly from individuals under 18 through the Services.

Changes to this Privacy Policy

We may update this Privacy Policy when Niz changes, when we introduce new providers or features, or when legal requirements change.

The "Last updated" date at the top of this Policy indicates when it was most recently revised.

Material changes may also be communicated through the application or website where appropriate.
